Are you due a refund on your Power of Attorney?

If you made a Lasting Power of Attorney (LPA) or an Enduring Power of Attorney (EPA) application in the last five years, you may be due a partial refund.

Why am I due a refund?

The Office of the Public Guardian (OPG) charged £110 for making a LPA.   The Ministry of Justice – which sets the OPG fees - found that while the running costs of the OPG fell, the Power of Attorney (PoA) application fee was not reduced accordingly.  This has resulted in about 1.8m people paying too much when applying for a Power of Attorney.

Am I eligible for a refund?

If you applied for a Power of Attorney in England or Wales between 1 April 2013 and 31 March 2017, you may be eligible for a refund.

Who can apply for the refund?

You can apply for the refund if

  • you are the donor – the person who made the PoA or
  • the Attorney – the person who was appointed by the donor.

How much is the refund?

How much you receive depends on when you made the PoA.  See the table below.

April to September 2013


October 2013 to March 2014


April 2014 to March 2015


April 2015 to March 2016


April 2016 to March 2017



You can still claim a refund even if you don’t know when you paid the fees.


How is the refund paid?

The refund must be paid directly to the donor.  If the donor has died, you must claim via the telephone number 0300 456 0300.

How do I claim?

You can claim online or by phoning 0300 456 0300.  If you are an existing client who has made an LPA with us, you can ask us to claim your refund for you.  We will charge a one off fee of £20 + VAT for this service. 

How long will the claim take?

The OPG says it will take around 12 weeks to process a claim.
