There has been a 38% increase in the number of wills being contested by dissatisfied beneficiaries according to High Court statistics. The number of cases in the High Court launched by children , spouses, and cohabitees rose from 80 in 2008 to 110 in 2009. There were only 10 challenges in 2006.
The recession is likely to be one of the reasons for the increase as this has had a significant impact on the size of estates and therefore there is a tendency for beneficiaries to fight for a greater share.
