Delays and problems at the probate office are causing further stress and anguish to the recently bereaved.

When a person dies, the person named as executor in the deceased’s will need to apply for grant of probate before they can deal with the deceased’s finances and share out their assets.

Executors are reporting lengthy delays in the issuing of grants and are complaining that they cannot get an update from the probate registry.
The probate service has said it cannot give updates and has asked people not to contact it. A note on the Liverpool District Registry Office’s website reads: “We are currently working on personal applications in the main around 5 to 6 weeks old and we will endeavour to take these to grant as soon as possible. We would ask at this time you only contact us if it is absolutely necessary”.
The latest problems come on top of delays last year when the probate office digitised many services and ended up with a huge backlog.

Executors of a will can apply for probate or they can appoint a legal professional to do if for them.
What if there is no will?
If a person dies without a will, their next of kin can apply for a grant of letters of administration.
How much does it cost to apply for a grant of probate?
Probate applications cost £215. If you use a solicitor to apply for probate, the probate fee is £155 plus the solicitor’s legal fees.
What do you need to apply for probate?
You will need a copy of the death certificate from the register office. Due to the coronavirus pandemic, councils have closed registry offices to the public, but you can register a death online or over the phone.
