Cyclist Accident Claims

If you’ve had an accident whilst out cycling that wasn’t your fault, you may be able to claim compensation for your injuries.

Common cycling claims include:

  • Being clipped or hit by a vehicle when cycling along the side of the road.
  • Hitting a pothole which caused you to have an accident.
  • Colliding with another cyclist.

Compensation can help pay for:

  • Damage to your cycle, equipment, clothing and personal belongings.
  • The cost of any medical treatment at the time of the accident.
  • The cost of any future treatment you may need, and any equipment you might have to buy because of your injuries.
  • An amount for your pain and suffering.
  • A sum to cover any actual and future lost earnings.

You can also claim compensation for any loss of amenity.

This might include, for example, a payment because:

  • You cannot cycle any more.
  • You can cycle, but it is painful and unenjoyable.
  • You can no longer do as much as you could before the accident.

Q: What if I wasn’t wearing a safety helmet?

In such circumstances, you will still be entitled to compensation. It is possible that, should your case go to court, the judge might decide to reduce the amount you are entitled to, if wearing a helmet would have made a difference to your injuries.

If you are a motor cyclist and are not wearing a crash helmet, the amount of compensation you are entitled to is usually reduced by 15% (or 10% if a helmet was worn but the chin strap was not fastened).

Q: What if I already had a condition which has been made worse by the accident?

It does not matter if you had an existing injury which made you more vulnerable to further injury – you will still be able to claim compensation. The person to blame for your cycling accident will be responsible to the extent that they aggravated or exacerbated your existing condition.
